What started it all: posted on the Defend Garden Station Facebook Group:

David Esrati
Note- you could send a message to Ms. Whaley by unliking her facebook page- which has 2003 likes- considering Defend Garden Station already has 1320 members and it started last night- I’m imagining there are a few of you who belong to both.

And, btw, the guy running for commission, who pro bono did the website and hosts it for free for Garden Station- he only has 313 Facebook likes Elect Esrati (insert link to Elect Esrati Facebook page here)

Dominick Lawniczak Evans
This should be about the Garden Station not about getting likes on Facebook. I personally don’t like either you or Nan Whaley’s pages. You because of your stance on disability rights and Whaley on this issue.

In a personal message to me we continued to talk below:

David Esrati
What position on disability rights do you have a problem with?

Dominick Lawniczak Evans
We spoke on your blog some months ago on your specific views on the ADA. You felt that disability parking shouldn’t be available if the buildings did not appear to be wheelchair accessible. You also wrote about the monetary costs the ADA infringes and the unfairness of this to businesses. While we can agree on one thing, the ADA is not the greatest legislation, we seem to disagree in why, as I believe it does not go far enough in securing protections for people with disabilities. It is the ignorance of able-bodied privilege to speak as if the disability populace isn’t the majority so accommodation should not be required.

David Esrati
I have no problems with new construction, it’s when the building can’t be made accessible, or has no need to be, that the law needs leeway. Find a position from Joey Williams or Jeff moms before you hang me please.

Dominick Lawniczak Evans
I haven’t hung anyone. What would constitute a building not needing to be made accessible? If it offers goods or services to the public, then it needs to be accessible.

David Esrati
Dominic, you’re a single issue voter the type of voter I find least responsible. I didn’t say the things that you said I’ve said, and there are not always instances where handicapped accessibility is mandatory. Blind people shouldn’t have to be able to be made accessible for at gun ranges end of story. go away!

Dominick Lawniczak Evans
I’m a person in a wheelchair who is also a disability rights activist. Of course I care heavily about how politicians plan to treat issues pertinent to people with disabilities as they affect me personally. I also live in a area full of people with disabilities. Thanks to WSU Dayton is full of people with disabilities. You should be conscious of that if you want to represent the people!

I also support other civil rights issues such as the rights of racial minorities, the LGBT community and gender equality. I’m a believer in the constitution and heavily support the bill of rights, particularly the right to free speech, the right of free press, and the separation of church and state. I believe in more gun control, and am pro-choice. I care about a lot of different issues. I also haven’t made up my mind on who I am voting for in the next election. I listen to what people say and hold them accountable. I believe lively debate is pertinent to making decisions on political issues.

I said that you said some buildings ‘had no need to be’ made accessible. I was responding in kind to that. Look above. I can directly quote you saying that. Heck I cut and pasted that and changed the tense of ‘has’ to ‘had’. Those are your words. Unless a phantom typed them for you, I’m quoting you directly.

You further show your ignorance of disability issues by saying blind people shouldn’t be allowed at gun ranges. Go tell that to a blind person and see how they react.

If you are running for public office you should consider the reaction you’ll get in telling one group of people you wish to represent in office what they “can or cannot” do, simply because of their disability (or skin color, or religion, or gender, or sexual orientation).

Also, you messaged me, and you tell me to go away? If you didn’t want to debate any type of issue why bother contacting me? If you were hoping to sway me to your side to vote for you…you aren’t doing a great job.

David Esrati
To clarify a few things- since you are busy gabbing about me on FB with @Andrew Cheadle-Ford and others. I’m not running for Mayor. I’ve only run for the city commission and for congress- not everything, and I’ve actually stood fast about government posting public documents in non-ada compliant ways.

As to ADA for all buildings- the example, was a family grocery store that was being built in an old grocery store. It’s not required by law to have public restrooms. There were two usable restrooms, the city required them to be made into 1 ADA compliant restroom- even though none of the people who worked there had a need- nor, could they access it- since the hallway was too narrow in the first place. The demolition of the separating wall, switchover to compliant fixtures- etc- cost over $9k. Sorry- that’s not smart.

Also- if you voted for Mike Turner, you voted for a war monger who has voted to continue wars that have turned tens of thousands of US citizens into people with disabilities- and maimed or wounded hundreds of thousands of Iraqis and Afghanis. Congratulations.

Have you found any positions posted by Jeff Mims or Joey Williams? I thought not.

Dominick Lawniczak Evans
I didn’t vote for Mike Turner. I don’t know where you get your information on that, but you seem bitter about him. I also don’t plan to vote for Joey Williams or Jeff Mims. I told you I have yet to make my decision on who I plan to vote for.

Further, the issue was about disability parking spaces in apartment buildings and you posting on your blog you didn’t think that they were necessary because the apartments were on the second floor – ignoring the fact that some people who use disability parking can climb steps albeit slowly and walk short distances. We were planning to move into a building downtown, at one point, on the 9th floor, in spite of my disability (I’m in a wheelchair) and there were plenty of adequate disability parking spaces. People with disabilities can live on any floors in apartment buildings.

David Esrati
Great- congrats. If you need a disability parking space, the city makes those available even on public streets. You move in- the sign goes up. But, should every building have one- just in case you decide to visit- no. And, I’m glad you didn’t vote for Mike Turner- as to bitter- no, he and his now, ex-wife, belong in prison for their graft and corruption- which if you’d read my blog about anything else other than your parking spot, you’d know about.

I’m done talking to you. I’ve done more for Garden Station than Nan ever did. She spent a quarter of a million dollars to get 5000 votes in the primary- that money could have done amazing things in Garden Station. Think about that.

Back on the FB Defend Garden Station Group:

David Esrati
As to Domenick – unfortunately, this is about politics- and who gets elected- I’ve supported Garden Station since the start- and if you look at their site- you’ll see a link to my business which provides hosting and design of the site for free.

You’ll also note, that I’ve been at the forefront of fighting for public records to be ADA compliant-
your single issue argument against me is lame and inappropriate, esp since you don’t live in Dayton.
I protested when the city spent $450K on the building that they are now ? handing over? to a developer. Our tax dollars, which could have gone to public spaces, parks, police, etc. instead were being gambled on development. We saw how well that worked with Sa-Bai didn’t we?

And Kroger on Wayne- where they squandered over $4 million.

The city had no business throwing Garden Stations little plot into this deal- without first discussing it- or making it clear that this beautiful, organic thing Lisa has built- has more value than anything a developer could do.

Goodnight all. Keep up the good fight.

Dominick Lawniczak Evans
This all takes away from the purpose of this page…to help Garden Station. These kind of squabbles are what detract from the issue at hand.

Also, I live in Washington Twp and have a Dayton mailing address. I’m pretty sure I vote for some Dayton elected officials.

Dominick Lawniczak Evans
Oh, and I have my own server & web space, too. If Garden Station wants to have free web space, I’m happy to host them…no strings attached. I did it for Occupy WSU when they wanted a website.

I wouldn’t need recognition for giving free space to a worthy cause or constantly reminding them who gave them space.

David Esrati
Dominick- you can go to hell. I have no use for sideline quarterbacks. Get on the ballot- do something- but in the meantime STFU if you don’t have anything constructive or add anything to the conversation.

David Esrati
And- no, you live in Washington Twp- you don’t vote here. You’re an idiot with an axe to grind- have a nice day.

Dominick Lawniczak Evans
David – Wow. I actually was planning to make a video of Garden Station. As a film student at WSU I have access to equipment and a lot of knowledge on filmmaking, but with this kind of attitude, why would I bother helping out? Since you seem to be a big part of Garden Station I don’t have to help out since it’s clear I’m not wanted.

Further, know who you are attacking before you attack them. I don’t have political ambitions as far as running for office, but I have done plenty in the disability rights and LGBT activism movements.

David Esrati
Dominick- talking about what you were planning to do isn’t the same as actually doing it. By the time you start making your film, we may have a parking lot instead, and I’m sure they will have plenty of disabled parking spaces for you. Please don’t engage me or mention my name anymore. I don’t have time for your bs. Everyone else, fantastic job of organizing so quickly- it’s a worthy unique beautiful thing you’ve all created!
